SOSGPS terms
These terms apply to the offer and sale of SOSGPS devices, SOSGPS Ready, SOSGPS Plus and related services to consumers in the Netherlands.

1. Who we are

2. Offer and agreement
An offer states the main characteristics, VAT-inclusive price, delivery costs, delivery period, selected connection, duration and cancellation terms. An agreement exists only after SOSGPS confirms an order or service in writing. A pre-order or availability request is not a purchase agreement, reservation, payment or delivery guarantee.
3. SOSGPS Ready, own SIM and SOSGPS Plus
Where stated in the offer, SOSGPS Ready includes a SOSGPS SIM and configuration of the device for the SOSGPS server. On your explicit instruction, supplied SOS contacts may be configured. You remain responsible for their accuracy and for having authority to provide them.
With your own SIM, you arrange the SIM, coverage, credit, APN and carrier support. SOSGPS support is limited to the server and device settings described in the offer.
SOSGPS Plus is the optional platform service for the SOSGPS account and its offered functions. Its terms are confirmed in the applicable offer or order confirmation. SOSGPS Plus does not guarantee a particular location accuracy, mobile coverage or availability.
4. Use, location and SOS
SOSGPS is not a medical device, monitoring centre, emergency service or replacement for emergency services. In an immediate emergency, always call 112. An SOS alert or location transmission can fail or be delayed because of battery, mobile coverage, GPS reception, device settings or local conditions.
Locations are estimates. GPS generally works best outdoors; Wi-Fi and mobile network positioning may be slower or less useful indoors. Battery life depends on settings, movement, coverage and use. Functions vary by model, firmware and configuration; only features confirmed for your device form part of the offer.
5. Delivery and use
We deliver in the Netherlands to the address and within the period in the order confirmation. Check the device on receipt and follow safety, charging and setup instructions. Do not use a device unlawfully, to track people secretly or contrary to applicable law. The account owner decides who receives location access.
6. Right of withdrawal
For an online purchase, you generally have a 14-day cooling-off period. For a device, it starts on the day after delivery; for a service, on the day after the agreement is made. You may withdraw through a clear statement to legal@sosgps.nl. After withdrawal, return the device within 14 days to the return address we confirm. Direct return costs are yours, except for defective or incorrectly delivered products.
If you expressly request SOSGPS Plus or another service to begin during the cooling-off period, a proportionate amount may be due for the service already supplied at your request. We record that request and its consequences clearly before purchase.
7. Warranty and remedy
You always retain statutory conformity rights: the device and digital service must meet reasonable expectations. In addition, we provide a one-year commercial warranty from delivery for manufacturing and material defects, in addition to—not instead of—statutory rights. Wear, loss, theft, damage through misuse, unauthorised modification, unsuitable charging equipment or use outside stated specifications are excluded from this commercial warranty.
Report an issue promptly to legal@sosgps.nl with the order number and description. If covered, we repair or replace free of charge within a reasonable period. If that is not possible or reasonable, your statutory rights to a price reduction or termination apply.
8. Price, payment, cancellation and changes
Prices and payment moments are stated in the offer or order confirmation. A continuing Plus agreement can be cancelled as stated in that agreement. We change price, content or terms for a continuing service only where reasonably necessary, with clear advance notice and subject to mandatory consumer law.
9. Liability and complaints
Nothing in these terms limits mandatory consumer rights. To the extent permitted by law, SOSGPS is not liable for loss caused solely by incorrect input, absent mobile or GPS coverage, an empty battery, force majeure or use contrary to these terms. Send complaints to legal@sosgps.nl; we respond within a reasonable period.
10. Law and language
Dutch law applies. Consumers may bring disputes before the court competent under law. In case of a discrepancy, the Dutch version prevails.
